The paperwork to junk a car in Florida comes down to what you can prove about ownership. A salvage dealer buying your car needs one of three things from you: a valid title, a salvage certificate, or a certificate of destruction. If your vehicle already carries a salvage designation, you’re on a clock. Florida law gives you 72 hours to forward that title to the Florida Department of Highway Safety and Motor Vehicles, known as FLHSMV. What a salvage dealer needs from you

Under FS 319.30, a dealer can’t legally buy your car without proof of ownership. That means a title signed over in your name, or properly endorsed if you’re not the original owner. Or a valid salvage certificate. Or a certificate of destruction. This rule protects both sides. It keeps a question about ownership from surfacing months after the car is gone.

If your car already became salvage

A vehicle becomes salvage in Florida when it’s a total loss. That happens when an insurance company pays you to replace the wrecked or damaged car, or, for an uninsured car, when repairing it would cost 80 percent or more of replacing it with one of like kind and quality. Once that happens, Florida law requires the titleholder to forward the title to FLHSMV within 72 hours. What happens next depends on the car’s condition. A salvage certificate of title means it’s still considered repairable. A certificate of destruction means the opposite. It authorizes a dismantler to break the vehicle down for parts or scrap. A certificate of destruction is what gets issued when repairs would run 90 percent or more of retail value on a late-model vehicle worth $7,500 or more, and it can only be reassigned twice.

If you don’t have the title

Plenty of cars headed for the junkyard don’t have a title in hand. Maybe the car changed hands more than once. Maybe it sat parked for years and the paperwork disappeared. Florida has a process for that: a derelict motor vehicle certificate application. The dealer and seller complete it together. Once it’s filed, the dealer has to hold the vehicle before dismantling it. Three full business days, or ten days if there’s a lien on the car under three years old. That hold gives a lienholder time to step in if they need to.

Don’t forget the license plate

One detail people miss constantly: the license plate belongs to you, not the car. Under FS 320.0609, you’re required to remove the plate before the vehicle is disposed of. From there you have two options. Return it, or transfer it to a replacement vehicle. Either way, don’t let it ride off attached to the car you’re junking.
